A federal judge has yet to reach a decision after hearing testimony on June 26 on a civil suit filed against Perdue Farms and grower Hudson Farm for alleged Clean Water Act violations. The plaintiffs were cleared of any wrongdoing in December, but had amassed nearly $3 million in legal fees. They filed a civil suit in an attempt to recoup those losses in a suit they deemed frivolous.
U.S. District Court Judge William Nickerson heard from both sides of the case, the Star Democrat reported, before putting the case on a "sub curia" status, meaning there will be no immediate timetable for ruling on the case.
The original suit, filed on March 1, 2010, by the Waterkeeper Alliance, alleged the Hudson Farm allowed runoff from the farm near Berlin, Md., to enter the streams that feed the Pocomoke River and ultimately the Cheseapeake Bay.
